1. Introduction

These Terms of Service ("Terms") govern your use of ParcelPing ("Service"), operated by PingTech ("Company", "we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms.

ParcelPing is a shipping notification automation service that sends automated email notifications to your customers when their shipment status changes.

2. Definitions

  • "Service" means the ParcelPing platform, including all features, tools, APIs, and related services.
  • "User" or "You" means any individual or entity that accesses or uses the Service.
  • "Customer" means the end buyer who receives shipping notification emails through the Service.
  • "Merchant of Record" means Paddle.com Market Limited, which processes payments on behalf of PingTech.

3. Account Registration

3.1. To use the Service, you must create an account and provide accurate, complete information.

3.2. You are responsible for maintaining the confidentiality of your account credentials.

3.3. You must be at least 18 years old or the age of majority in your jurisdiction to use the Service.

3.4. You are responsible for all activities that occur under your account.

4. Use of Service

4.1. You may use the Service only for lawful purposes and in accordance with these Terms.

4.2. You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Send spam, unsolicited messages, or misleading content through the Service
  • Attempt to gain unauthorized access to the Service or its related systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Resell, sublicense, or redistribute the Service without our written consent
  • Use the Service to transmit any harmful code, viruses, or malicious software

5. Subscription and Payment

5.1. The Service offers both free and paid subscription plans. Details of each plan are available on our website.

5.2. All payments are processed by Paddle.com Market Limited ("Paddle"), acting as our Merchant of Record. By purchasing a subscription, you also agree to Paddle's Checkout Buyer Terms.

5.3. Paid subscriptions are billed on a recurring monthly basis unless otherwise specified.

5.4. Prices are subject to change with prior notice. Continued use of the Service after a price change constitutes acceptance of the new price.

5.5. Paddle handles all invoicing, tax calculation, and payment processing on our behalf.

6. Free Plan

6.1. The free plan allows limited usage of the Service as specified on our pricing page.

6.2. We reserve the right to modify or discontinue the free plan at any time with reasonable notice.

7. Cancellation

7.1. You may cancel your subscription at any time through your account settings or through the Paddle customer portal.

7.2. Cancellation takes effect at the end of the current billing period. You will continue to have access to the Service until then.

7.3. No refunds will be provided for partial billing periods, except as described in our Refund Policy.

8. Intellectual Property

8.1. The Service, including its original content, features, and functionality, is owned by PingTech and is protected by international copyright, trademark, and other intellectual property laws.

8.2. You retain ownership of all data you provide to the Service, including order data, customer information, and custom email templates.

8.3. You grant PingTech a limited, non-exclusive license to use your data solely for the purpose of providing the Service.

9. Data and Privacy

9.1. Our collection and use of personal information is governed by our Privacy Policy.

9.2. You are responsible for ensuring that you have the right to share your customers' data with the Service, including obtaining any necessary consents.

10. Third-Party Services

10.1. The Service integrates with third-party services including, but not limited to, Shopify, 17TRACK, and Paddle.

10.2. Your use of these third-party services is subject to their respective terms and conditions.

10.3. PingTech is not responsible for the availability, accuracy, or reliability of third-party services.

11. Service Availability

11.1. We strive to ensure the Service is available at all times but do not guarantee uninterrupted access.

11.2. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control.

11.3. We will make reasonable efforts to provide advance notice of scheduled maintenance.

12. Limitation of Liability

12.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PINGTECH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

12.2. Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12.3. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

13. Indemnification

You agree to indemnify and hold harmless PingTech, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

14. Modifications

14.1. We reserve the right to modify these Terms at any time.

14.2. Material changes will be notified via email or through the Service.

14.3. Continued use of the Service after changes constitutes acceptance of the modified Terms.

15. Termination

15.1. We may terminate or suspend your account at any time if you violate these Terms.

15.2. Upon termination, your right to use the Service will immediately cease.

15.3. Provisions that by their nature should survive termination shall remain in effect.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea.
